1. Agreement
These Terms of Use ("Terms") govern your access to and use of paintedthorn.net (the "Site") operated by Painted Thorn ("Painted Thorn," "we," "us," or "our").
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Our Privacy Policy (posted on the Site) explains how we handle information, including optional email-list signup. It is incorporated by reference into these Terms.
2. Who we are / the Site
The Site provides information about Painted Thorn and our games, including the work-in-progress title Clean Up My Bulk (a game about organizing, selling, and collecting trading cards).
The Site is a studio and marketing presence. Information about unreleased or in-progress games may change. Nothing on the Site is a promise of a release date, feature set, platform availability, or final product.
Games distributed through Steam or other platforms are also subject to those platforms' terms. These Site Terms do not replace the Steam Subscriber Agreement or other storefront terms.
3. Eligibility
The Site is intended for young adults and a general adult audience. You must be able to form a binding contract under applicable law to agree to these Terms. If you are under the age of majority where you live, you may use the Site only with involvement of a parent or guardian as required by law.
4. Intellectual property
Unless otherwise noted, the Site and its contents — including the Painted Thorn name, the rose studio mark, the Clean Up My Bulk name and card-stack game mark, text, graphics, layout, and other materials — are owned by Painted Thorn or its licensors and are protected by intellectual property laws.
You may view and use the Site for personal, non-commercial purposes in the ordinary course of browsing. You may not copy, scrape, modify, distribute, publicly display, reverse engineer, or create derivative works from Site content or marks except as allowed by mandatory law or with our prior written permission.
All trademarks and logos on the Site are the property of their respective owners.
5. Acceptable use
You agree not to:
- use the Site for any unlawful purpose;
- attempt to gain unauthorized access to the Site, related systems, or other users' information;
- interfere with or disrupt the Site (including via malware, overload, or automated abuse);
- scrape or harvest content or contact addresses for spam or commercial bulk messaging;
- submit false or someone else's email address to our email list without authority;
- impersonate Painted Thorn or misrepresent your affiliation with us;
- harass, threaten, or abuse our team via Site contact channels.
Studio contact addresses (including press@, support@, development@, sponsors@, legal@, and games@ at paintedthorn.net) are for legitimate correspondence only.
6. Email list
The Site may offer an optional signup so you can receive studio and game updates by email. Messages are sent from games@paintedthorn.net. Signup requires your consent (for example, by submitting the form). You can unsubscribe at any time via the link in those emails or by contacting us as described in the Privacy Policy.
List mail is informational (studio/game updates). It is not a commitment to any feature, release date, or product. Our Privacy Policy covers how we handle list signup data (including use of Resend as our delivery provider).
7. User communications
If you email us, you grant us a non-exclusive right to use the content of that communication as needed to respond and operate our business (for example, to investigate a support issue). Do not send content you do not have the right to share.
The Site does not currently host public user-generated content (comments, forums, or uploads). If we add such features later, we may update these Terms with additional rules and licenses.
8. Third-party links and services
The Site may link to third-party sites or services (including Steam, social platforms, email infrastructure such as Resend, or tools). We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
9. Games; multiplayer (future)
Clean Up My Bulk and other Painted Thorn games may be offered through Steam or other storefronts under separate product pages and platform rules. Current builds are not multiplayer; multiplayer or other online features may be added later. Additional terms or privacy updates may apply when those features launch.
10. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINTED THORN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that information about work-in-progress games is complete or final.
Some jurisdictions do not allow certain disclaimers; in those places, disclaimers apply to the fullest extent permitted.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINTED THORN AND ITS OWNERS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
These limits do not apply where prohibited by law (including where liability cannot be limited for gross negligence, willful misconduct, or certain consumer rights).
Counsel should review this section for Florida/Texas and any other applicable consumer rules before relying on it in a dispute.
12. Indemnity
You agree to defend, indemnify, and hold harmless Painted Thorn and its owners, operators, and affiliates from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of someone else's rights — to the extent permitted by law.
13. Termination
We may suspend or stop offering all or part of the Site (including the email list) at any time. You may stop using the Site and unsubscribe from the list at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, except where mandatory consumer law in your place of residence requires otherwise.
A move of the studio's formal business entity to Texas is planned. When that entity is formed and becomes the operator of the Site, these Terms should be updated to reflect Texas (or other) governing law and venue as counsel advises.
Exclusive venue for disputes arising from these Terms or the Site that proceed in court will be the state or federal courts located in Florida, unless mandatory law requires another forum, or unless we update this section after the Texas entity is live.
15. Changes
We may modify these Terms by posting an updated version on the Site and revising the "Last updated" date. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms where permitted by law. If you do not agree, stop using the Site.
16. General
These Terms are the entire agreement between you and Painted Thorn regarding the Site, and supersede prior agreements on that subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of assets.
